How high is the equalization claim?

Each side’s gain is what it added to its assets during the marriage. Half of the difference is equalized.

How the calculation works

The gain is final assets minus the adjusted initial assets and inheritances, never less than zero (§ 1373 BGB). The claim is half of the difference, at most as much as the paying side has at the end (§ 1378 BGB).

Inheritances and gifts count toward initial assets and are exempt from equalization (§ 1374 (2) BGB). If the marriage and cut-off date are set, the calculator adjusts them using the consumer price index.

The calculator does not cover what is usually disputed in practice: the value of real estate, a business or a life insurance policy, latent tax liabilities and disloyal reductions of assets (§ 1375 (2) BGB).
