Separation, divorce, maintenance, custody: in the middle of life and in the middle of a new quarter. Questions of family law are better discussed in a conversation than in passing, and for that we are right next door: our office is at Frankenallee 230 in the Gallus, and the Europaviertel begins around the corner.

For a first appointment you therefore do not have to drive into the city centre or look for a parking space; a short walk is enough. If you prefer, much of it works digitally just as well, both routes are equal, and you do not have to commit in advance.

The
quarter

A young quarter with subjects of its own

The Europaviertel grew up on the site of the former central goods station: a new quarter with many young families, freshly acquired homes and a high number of international couples.

That shapes the instructions that come from here as well. It is disproportionately often about the shared flat on a separation: who stays, who keeps paying the loan, at what value it enters the assets calculation. It is about the equalization of accrued gains for couples who have only built up in recent years what now has to be divided. And for binational couples the question of the competent court and the applicable law comes before everything else.

Which family court decides

For family matters from the Europaviertel, the Amtsgericht Frankfurt am Main (local court) has jurisdiction as the family court. Which court decides locally in the individual case follows § 122 FamFG, usually according to where shared minor children live or where you last lived together. We clarify the forum bindingly before the application is filed; it has no influence on your choice of firm, because local admission no longer exists.

The marriage certificate and what else belongs with the application

For the divorce application we need your marriage certificate. If you married in Frankfurt you obtain it from the registry office in Frankfurt am Main; otherwise the registry office of your place of marriage is responsible, and where you married abroad an apostille or legalization and a certified translation come on top, depending on the state.

Beyond that we need little: the birth certificates of shared minor children, details of both spouses' income and the pension insurance numbers for the pension rights adjustment. Which documents are specifically needed in your case we tell you in advance, so that nothing is missing.

Costs

What the first conversation costs

The first conversation costs 190 euros plus VAT. The amount is fixed before you come and does not grow with the length of the conversation or the difficulty of your case (§ 34 (1) RVG); where an instruction follows, we set it off against the overall bill. What you entrust to us is subject to a lawyer's duty of confidentiality from the first minute.

The costs of the proceedings themselves then follow the value in dispute, which the court measures among other things by the income of both spouses (§ 43 FamGKG), not by how contested the divorce is. How we support you

The contact for new enquiries is Mieke Karcher, attorney at law. She has been admitted since 2010, is a member of the Rechtsanwaltskammer Frankfurt am Main and conducts the family court proceedings, from the amicable as well as the contested divorce through maintenance to custody and contact rights. She completed her legal traineeship among other places at the regional court and the local court in Frankfurt, that is at the same courts before which she appears today.

As soon as it is about the flat, about property values or about business assets, Dietrich Karcher, attorney at law, takes responsibility for that part. He brings more than 30 years of civil law and alongside that has worked for years in real estate, self-employed and as head of the property department at a state bank: with an owner-occupied flat and a running loan, that is the difference between a solution that is legally possible and one that is actually bearable. Advice is given in German, English and Spanish, for the many international couples in the quarter often the decisive point.

course

How the proceedings run

You call or write briefly about what it is about; we reply to written enquiries usually within one working day, and an appointment can as a rule be arranged within a few days. In the conversation we clarify your situation, the conditions, among them the year of separation under § 1566 (1) BGB, and the further steps. After that you obtain the documents, we formulate the application and file it with the competent family court; from there to the order, an amicable divorce as a rule takes four to six months, in which above all the pension providers' replies for the pension rights adjustment need time. Both spouses appear in person at the divorce hearing; everything before it can be handled digitally if you wish.

Both, and you can switch at any time. Precisely because we sit next door, an appointment in person is uncomplicated; if you prefer, much of it can be handled by telephone, email and video, right through to an online divorce.
