The process

How a divorce works

From the Trennungsjahr (year of separation) to the decree in five steps. How long it takes depends mainly on how quickly the pension providers respond.

  1. The year of separationapprox. 12 months

    You live apart for a year, which is possible in the same home too. Maintenance, accounts and who stays in the home for now can be settled already.

  2. The first consultationapprox. 1–2 weeks

    We discuss what you want to achieve in the end and what worries you most. That shapes the strategy, at our office, by video or by phone.

  3. The petition at the family courtafter the year of separation

    We file the petition for you, as you cannot file it yourself. If you agree, one lawyer is enough for the entire proceedings.

  4. Pension information and other issuesapprox. 3–6 months

    The court obtains information from the pension providers, and that takes longest. During this time we settle maintenance, assets and the home.

  5. Hearing and decreeoften 15 minutes

    You both attend the short hearing and confirm that you want the divorce. Once the decree is final, you are divorced.

What it costs

Costs set by law, not by the hour

Court and lawyer fees follow statutory tables. We do not charge by the hour. How high the costs turn out depends on four things:

  • IncomeThe net income of both spouses has the greatest effect on the Verfahrenswert (value of the proceedings).
  • AssetsDepending on the court, they count toward the Verfahrenswert (value of the proceedings).
  • Pension rightsEach right in the Versorgungsausgleich (pension rights adjustment) increases the value.
  • One or two lawyersIf you agree, only one side needs a lawyer.

How do I get an appointment?

Send us a request online. We usually get back to you on the next working day and agree on a time with you.

Do I have to come to Frankfurt?

No. The first consultation also works by Zoom, and you submit your documents online. We work for clients all over Germany.

How the online divorce works

What should I bring to the first consultation?

If you have them, your marriage certificate, your latest pay stubs and your pension statement, plus any marital agreement. If something is missing, come anyway.

Can you represent both of us?

No, we may only ever represent one side, even if you agree. In an einvernehmliche Scheidung (uncontested divorce), however, the other side does not need a lawyer of their own.
