  • Real estate and assets

The first step

Separation – before the divorce begins

Almost every one of these paths begins at the same point. Before a divorce can be filed, a clear separation is required. As a rule, couples must live apart for at least one year – the so-called year of separation. We support you already in this phase and show you how the separation can be arranged with legal certainty, even if you still live in a shared home.

Together we clarify questions of separation maintenance and sensible arrangements for children. A well-prepared separation is often the decisive step towards a fast, fair and low-conflict divorce. How the proceedings then unfold step by step is shown below.

Year of separation

12 months

Minimum duration of separation before the divorce petition can be filed.

  • Possible even within the shared home
  • Clarify separation maintenance early
  • Sensible arrangements for the children

How a divorce works at the family court

  1. Begin the year of separation

A prerequisite for every divorce in Germany.

  2. Personal consultation

We clarify maintenance, assets, arrangements for children and strategy.

  3. Divorce petition at the family court

We handle all legal steps and file the petition for you.

  4. Review pension rights adjustment

The court calculates the pension entitlements – we help with the preparation.

  5. Divorce hearing in Frankfurt

A short court hearing – we are by your side.

  6. Goal reached

    Divorce becomes final

You receive the court's divorce decree and are officially divorced.

Your document folder

For these steps to run smoothly, the right documents matter. This overview shows which documents you should best gather in advance.

  • ID card or passport of both spouses
  • Marriage certificate – with translation if there is an international element
  • Birth certificates of joint children
  • Proof of income (payslips, tax assessments)
  • Evidence of assets, accounts and debts
  • Documents on real estate (land register, purchase contract)
  • Pension insurance record for the pension rights adjustment
  • If available: prenuptial or separation agreement

Costs

What a divorce costs

Once the documents are together, it also becomes possible to estimate what lies ahead financially. The cost of a divorce depends on the value of the proceedings – it is derived from the income and assets of both spouses. Court and lawyer fees are based on this, following the statutory rules.

Value, not the dispute

What counts is the income and assets of both spouses – not how contested the divorce is.

Statutory fees

Court and lawyer fees follow the statutory rules (FamGKG, RVG) and are therefore transparent.

Amicable: often one lawyer

In an amicable divorce, as a rule only one spouse needs to be represented by a lawyer.

The actual amount depends on your individual case. Our divorce cost calculator gives you a non-binding orientation.
